These terms are the agreement between you and Oktet. They explain the rules for using the app, what you can and cannot do, and the limits of our responsibility. Please read them. By using Oktet, you agree to these terms. If you do not agree, do not use the app.
Oktet is a private, invite-only messaging app, operated as a sole trader based in New South Wales, Australia (ABN 21 160 303 234). In these terms, "Oktet", "we", "us" and "our" refer to that operator, and "you" refers to you, the user. Oktet is currently in a closed beta.
You must be at least 18 years old to use Oktet. By using the app, you confirm that you are 18 or older.
You sign in using your phone number, verified by a one-time code. You are responsible for keeping access to your phone and account secure, and you are responsible for all activity that takes place under your account.
There is no tolerance on Oktet for objectionable content or for abusive users. If you post objectionable content, or behave abusively toward others, your content may be removed and your account may be suspended or terminated, without notice.
You agree not to use Oktet to create, share, store, or transmit any of the following, and not to behave in any of the following ways:
More generally, you agree not to use Oktet for any purpose that is unlawful, harmful, or objectionable.
Oktet provides tools to help keep the service safe. You can report a message, post, response, or image from within the app, and you can block another user.
When we become aware of a report of objectionable content, we will review it and, where the content breaches these terms, act within 24 hours by removing the content and removing the user responsible. You can also reach us directly to report objectionable content or abuse at [email protected].
We may, at our discretion and to the extent permitted by law, remove any content, and suspend or terminate any account, where we consider it necessary, including for breach of these terms, to protect other users, or to comply with the law. Where we can, we will give you notice, but we may act without notice where the circumstances require it.
We will cooperate with law enforcement and regulators, including the Australian Federal Police and the eSafety Commissioner, and we will report illegal content where we are required or consider it appropriate to do so.
You keep ownership of the content you create and share on Oktet. We do not claim ownership of it.
By posting content, you confirm that you have the right to share it, and that doing so does not break the law or infringe anyone else's rights. You are responsible for the content you post.
You grant us a limited licence to host, store, process, and display your content only as needed to operate the service, for example, to store your images and to show your messages and posts to the other members of the channels you are in. This licence is limited to running Oktet and ends when your content is deleted, except where we are required to retain it for a short period to meet legal or safety obligations.
You can delete your account at any time from within the app, under Settings. What happens to your information when you do is described in our Privacy Policy. In short, your content stops being visible to others immediately and is permanently erased within 90 days.
We may suspend or terminate your access to Oktet if you breach these terms, or where we reasonably need to in order to protect the service or other users.
Oktet is a closed beta and is provided on an "as is" and "as available" basis. We do not promise that the service will always be available, uninterrupted, secure, or free of errors, and we may change, suspend, or discontinue any part of it at any time. To the maximum extent permitted by law, we exclude all warranties, representations, and guarantees that are not expressly set out in these terms.
To the maximum extent permitted by law, we are not liable to you for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss of data, loss of profits, loss of goodwill, or loss of opportunity, arising out of or in connection with your use of, or inability to use, Oktet, whether that claim is based in contract, negligence, or any other legal theory, and whether or not we were advised that such loss was possible.
To the maximum extent permitted by law, our total liability to you arising out of or in connection with Oktet is limited to resupplying the service or, where that is not possible, to AUD $100.
Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied.
To the maximum extent permitted by law, you agree to indemnify us and hold us harmless against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal costs) that arise out of or in connection with: your use of Oktet; the content you post; your breach of these terms; or your breach of any law or of anyone else's rights.
We may update these terms from time to time as Oktet develops. When we do, we will change the "last updated" date at the top of this page, and we will let you know within the app where the change is significant. By continuing to use Oktet after a change takes effect, you agree to the updated terms.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
